Automobile as a multilevel associated industry, has been a strong and leadingrole of the upstream industries and downstream services, and a more obvious role inthe process of the development of the world economy, it is gradually becoming themajor pillar industry for automobile producing countries. Under the background ofeconomic globalization, total number of automobile exports for every car-producingcountry has expended each year. Especially, since China’s accession to the WTO,China’s automobile export volume growth was in a “blow out” situation.However, to achieve sales and market share in China’s own brands haveincreased behind some problems still can not be ignored. With the development ofChina’s automobile industry the car’s total exports has expanded each year, tradefriction becomes more and more frequent. Foreign countries usually take safeguardof national economic security, intellectual proprietorship, and environmental issuesas excuses to implement harsh technical barriers on trade on China’s exports ofautomotive products, in the actual purpose to protect native automobile industries.Meanwhile, developed countries combined intellectual property, patents andstandards to form a new type of technical barrier to trade, which is more complexand more difficult to get across, more over they world widely use a morecomprehensive intellectual property strategy and patent applications. Frequently usethe legal procedure to protect their ownership of the patents and their intellectualproperty rights against local brands, to inhibit competitors’ development. Theproblem of China’s own brands that needs to be taken into consideration is that howto improve the capability of independent innovation, optimize intellectual propertystrategy, and enhance their international competitiveness, so that get across of thetechnical barriers to trade. In this paper, take intellectual property infringement between GM and Qi Rui asa case study, to analyze intellectual property strategy of well-known auto companies,use several theories focusing on the conflict brought by new type of technicalbarriers to trade to Chinese automobile brands and its developing trend. On this basis,from a enterprise strategic perspective and industry policy level to analyze thedevelopment situation and existing problems of China’s automobile industry, thenexplore the appropriate way of innovation and a proper solution of enhancinginternational competitiveness for both China’s automobile industry and enterprises.There are six chapters in this dissertation, they are arranged as follows:Chapter one is the introduction, sets out the research background andsignificance of the topic, which is the overwhelming phenomenon of moreintellectual property, patent and standard combined trade protective measures aretaken into application that has a great impact on international trade of automobileindustry. As a result, there are more intellectual property infringements againstdomestic auto companies. Thus, it is vital to understand well WTO trade relatedrules and intellectual property strategy of other firms.Chapter two analyzes the current status of China’s auto brands, at the same time,overview the intellectual property strategy of famous multi-national enterprises.Chapter three compares rules and regulations about technical barriers to tradefrom WTO and other countries to analyze the real purpose of intellectual propertylitigation. Use data analysis based on patents applied by automobile firms to analyzethe result of law suits. Meanwhile, a comparative study is applied to review thedeficiencies of China’s auto brands from well-known car brands.Chapter four tries to analyze the current independent innovation status ofChina’s auto brands from the perspective of awareness of innovation, R&D inputsand intellectual property strategic system.Chapter five suggests measurements need to be taken from both macro andmicro level to improve international competitiveness standard of China’s automobileindustry.Chapter six summarizes the only solution for China’s own brands get across new type of technical barriers to trade is to combine both independent innovation strategyand intellectual property strategy.
