Establish an efficient modern agricultural land property rights system under market-oriented, and improve the farmers’land property rights system to protected farmers’land property rights and interests in the process of marketization is not only the major topics of current theoretical study, but also the realistic way to further deepen rural reformand solve the three rural issue. The current research on agricultural land property rights system have already been multi-perspective and more in-depth analysis. The understanding of the structure of agricultural land property rights is based on the perspective of the legal rights, taking into account the differences between the subjects of rights and its affect among various rights constitute, But it is too broad and abstract.The acquisition of property rights is determined by property ownership, political system, legal and moral and ethical. In this paper, using Barzel property rights theory to analyze the agricultural land ownership structure of China, and discuss how to optimize the structure of agricultural land property rights. Then, combing the present stage of agricultural land property rights system briefly, and it shows that the agricultural land property rights is ambiguous, the property rights owned by the state, rural collective organizations and farmers, the three parties (especially between the rural collective economic organizations and farmers) interact and restraint each other to control parties right when exercise the control rights, it is only be determined through negotiation or even bargaining. To explore the mechanisms involved, the reseach based on the analytical framework before, using Barzel’s analysis paradigm to the different value of agricultural land property, construct a raw agricultural land property rights model of government behavior. The improvement of the institutional environment to improve the income of agricultural land property rights, or be able to reduce the execution cost of the property rights of agricultural land.Based on these results, the policy recommendations:to further improve the legal system of agricultural land property rights, foster farmers’organizations in the modern agricultural land property rights system to speed up the construction of the agricultural land market system, the establishment of a sound agricultural land property rights system to match the security system.
