As one of China’s three major education form, vocational education has beenincreasingly valued by the state and the society around. Due to its development, groups oftechnological talents have been fostered to meet up the great demand in production line. Forthe time being, vocational education is more and more closely tied to the development ofeconomy, while being one of its main development pattern, the cooperation between schooland enterprise played a crucial role in cultivating talents. However, much room has stillbeen left in perfecting the overall system as well as seeking solutions to its practical theoryapplication. Generally speaking,developed in our whole country,it had a very big scale andinvolved a large number of students.In addition,it was not balanced in its nationwidedevelopment and had so many differences in development levels and other aspects. Theexistent disadvantages such as role ambiguity of parties concerned, undefined governmentresponsibilities, and badly-maintained rights and interests of teachers and students paled itsmove toward perfection. Joint efforts are demanded to solve them, and the tool of law, as asymbol of authority, universality and the most widely accepted norms, is indispensable inparticular. We have already had some relevant laws with ambiguous and indecisiveexpression and the articles are unfeasible to put them into practice. Regulations of Ningbocity to promote the development of cooperation between school and enterprise, the firstspecially-made law to promote the development of cooperation between school andenterprise in China, made the provisions to help solve the problems revealed during itsdevelopment. As it is only a local legislation with a limited scope of application and achaotic structure, the law can’t meet the development need of cooperation between schooland enterprise. Situation of No Rule to Follow and No Legal Basis present in thecooperation between school and enterprise results from the lack of specific norms forreference, yet what is largely to be blamed is the unsubstantial preliminary framework of theexisting laws and regulations.According to China’s national conditions, the paper shall demonstrate some helpfulviewpoints in advancing the legislation of school-enterprise cooperation in China,such aslegal characteristics, Legal system and Structural arrangement,on a basis of analyzing thecharacteristics of China’s cooperation between school and enterprise and learn from thegood examples, current law practice relevant and the problems lie within.
