Research On Legal Issues Of The Recovery Of Lost Cultural Relics

In the history of human civilization, our industrious and intelligent people created incredible civilization and left a lot of cultural relics for us. However, cultural Properties of many countries have been lost overseas because of incomplete conventions and civil laws. Especially for China, because of war booty, stealing, smuggling, illicit trade and so on, a mass of national treasures lost all over the world now. The thesis researches the legal issues about the recovery of lost cultural relics.The thesis consists three chapters:The first chapter introduces the common issues of lost cultural relics, such as the concept of the lost cultural relics, the present situation of the lost cultural relics, the basic theory and the legal of the recovery of lost cultural relies, and the basic approach of the recovery of lost cultural relics.The second chapter describes the main legal issues in the recovery of lost cultural relics, including legislative limitations, legal issues of international litigation and international arbitration. By comparing the domestic and foreign legislation, as well as introduce foreign classic case to focus on to set out these three important questions.The third chapter discusses the improvement of the legal system about the recovery of lost cultural relics, and mainly includes three aspects:strengthen the protection of cultural relics legislation, improve the international litigation system and international arbitration system. This chapter based on the three aspects of the second chapter, give some practical suggestions to help the recovery of lost cultural relics to carry out more effective.
