| This dissertation is about case analysis of Gao Liya v. Four Kilometers Primary School. It can be generally divided in to three parts. In the first part it will give basic facts of the case, which is mainly about that a teacher of the Four Kilometers Primary School, whose name is Gao Liya sued the Four Kilometers Primary School four times but failed four times. In the fifth suit, she accepted legal advice from legal authorities, changed her reason of the suit from property right appeal to copyright appeal and at last won the suit. In the second part, it will analyze the focus of dispute of the case which includes:1. whether the copyright of Syllabus is included in the range of works which is protected by the Copyright Law. If it is, who will get the copyright of Syllabus?2. It will analyze the ownership of Syllabus;3. It will analyze the legal responsibility in this case. In the third part it will give some recommendation about the development of the legislation in Copyright Law and the protection of the copyright. It includes:1. the Copyright Law should clearly provide the range of works, the difference between Work for hire and Corporate Works and the ownership of object which is combined by knowledge and entity.2. Schools can set up specialized department to protect the copyright of teachers.3. Teachers should know more knowledge about the Copyright Law so that they can protect their copyright themselves. The dissertation will mainly base on the study of the laws, acts and regulations relating to Copyright Law. It will use the case study approach to show focus of dispute of the case; black letter approach will be used to examine the acts, laws and regulations relating to this case. The comparative approach is used to compare the different viewpoint in this case. |
