Research On Protection Of The Rights And Interests Of Landless-farmers In The Western Region In The Processing Of Urbanization

Urbanization is undoubtedly one of the2013"NPC and CPCC" the most popular topic. Once won the Nobel Prize in economics for American scholar Joseph Stieglitz said that America’s high-tech industries and China’s urbanization is influence the contemporary global economy and the world’s two most important factors of the society. But with the emergence of accelerated development of urbanization will bring a large number of landless-farmers. In the western development policy under the guidance of the western area, urbanization rate is also rising, in recent, the problems of landless-farmers also come one after another and increasingly serious, but for the study of landless-farmers in the region less. In view of this based on the western region of landless-farmers’ rights and interests protection as the research topic.This study chooses the landless-farmers in the underdeveloped L Village, Bijie City, Guizhou Province, inhabited by ethnic minorities in western China as the research object, and uses in-depth interview to collect data for analysis. It strives to describe and discusses the social security problems and appeals of these landless-farmers after they lost their land to survive. The use of depth interviews to collect data and analyze them, try the political rights and interests of landless-farmers from land expropriation process, economic rights, social security rights and interests of three aspects to describe this part after losing land to the survival of the status quo of farmers:First is aphasia, Political rights and interests is damaged, in the process of land expropriation, lack to maintain their legitimate rights and interests of say; Second is less money, economic rights and interests is damaged, directly reflected in land expropriation and compensation claims, less influence long-term livelihood; Third is not confirmed, social security rights and interests is damaged, after landless-farmers endowment, medical, etc so as to protect the problem not timely; Fourth is jobless, also is the lack of social security rights and interests, lost ground after the government not to farmers for job placement and corresponding reemployment training organization. And then from the macro level system dimensions, microcosmic combining government dimension and individual dimension to analyze the causes of problems, land property rights are unclear, mainly old land supply system used in the new land acquisition environment formed asymmetric suited to the wrong tooth, government and farmers in the process of the game in the right position of strength, government employment training lack of responsibility, the interests of the individual short-sidedness, ability poverty, etc. Finally from establishing and perfecting the relevant legal system of land, improve land expropriation compensation mechanism, changing the ruling idea reform performance appraisal system to protect the political rights and economic rights and interests of landless-farmers, at the same time, basing on the needs of the farmers, tailored by innovative ideas, put forward from the lowest life guarantee, old-age security, employment security, and other dimensions to establish the social security system to ensure the social security rights and interests of landless-farmers, summary of forward integration to solve the landless-farmers’rights and interests safeguard policy suggestions, aims to build on the premise of reform, improve the system of land and diversified innovation compensation mechanism as the key, and customize the security mode to take the core integration system to safeguard the rights and interests of landless-farmers. The hope of providing evidence and value for the government and relevant land requisition departments for reference to solve the problems with landless-farmers in undeveloped and multi-ethnic regions in western China.This paper consists of six parts:The first is introduction, this chapter mainly elaborated "two high one lag behind" the research background, research questions and research significance.The second is literature review, first expounds the relevant concepts and theories in paper, and then from abroad and domestic, national policy three aspects to review the study of landless-farmers are existing.The third is research ideas and methods, mainly introduced the paper has used case interview of qualitative research method, researchers and introduces how to use this method to do research.The forth is the results showed that the mainly from the political rights and interests of landless-farmers in the process of land expropriation, economic rights, social security rights and interests of three aspects to describe the results of the study.The fifth is the discussion and suggestions, mainly from the macro and micro two layer, system, government, individual three dimensions to discuss western region farmers rights and interests of the present situation of the lack of security, and from the legislative priority, and the transformation government norm, establish and improve land multiple compensation mechanism, in order to safeguard the rights and interests of landless-farmers and customize aspects put forward the policy suggestions.The sixth is the conclusion, mainly summarizes the full text, and put forward the article deficiencies.
