The Older Unmarried Cohabitation Law Problems And The Countermeasures

With the trend of population aging in our country deepens, the proportion of the elderly unmarried cohabitation is rising simultaneously. However, most people in our society were sympathizing and tolerant with the phenomenon of live together "silver" and "travel together endowment". Just because of the ubiquitous phenomenon of unmarried cohabitation, it puts the elderly remarried in an unstable state. For social environment, the elderly unmarried cohabitation can also causes property disputes; support of complicated problem and it even brings negative impact on young people’s marriage values.According to our current law, there are no clear rules for unmarried cohabitation. Although no ban free method, guidance and regulation in unmarried cohabitation is necessary.The thesis consists of four parts:The first part is the basic problems of elderly unmarried cohabitation. In this part, the author mainly introduced some conceptions as well as the differences between other related conceptions. Thus, the reader could understand the main body and the differences between different conceptions through the introduction. So the following discussion could be more clearly.The second part is the reasons, characteristics and problems that caused by elderly unmarried cohabitation. This part is written from the perspective of the current situation of society and existing problems. Owing to the existence of these contradictions and disputations, there are no effective ways to solve the unmarried cohabitation until now.The third part is the necessity of establishing regulations of unmarried cohabitation. According to the problems discussed above, the author points out the necessity of legislation through rational analysis. The author thinks that it is necessary for us to analyze the problem and solve the problem specifically and further perfect the legislation of unmarried cohabitation.The fourth part is the current situation of legislation and countermeasures towards the problem. Based on the analysis and demonstrations above, the author puts forward the innovative ideas in this part, that is to say, fundamentally solve the chaotic situation of unmarried cohabitation, further perfect the legislation and promote the harmonious development of the society.
