Legal Responsibilities Of Mobile Phone Application Stores In An Invasion Of Privacy

As the birth mark of information age, mobile phone application store (AppStore) brings mobile users with great convenience along with the development of telecommunication and internet technology in this smart era. However, mobile users are also exposed to vital threats of privacy invasion while enjoying the convenience brought by the AppStore. Through research methodology of case study and logic deduction, this paper aims to give a detailed analysis on the issue of legal responsibility related to privacy right invasion by Appstore. Based on the adoption of other region’s legislation experience, the summary of current relevant legislation circumstances and the special consideration on distinctive characteristics of Appstore, this paper comes to conclusion that it is very necessary to create an Dual structure for imputation principles and responsibilities constitute due to privacy right invasion by Appstore. This means that different behavior by different invasion subject under different circumstance should be coordinated by specific imputation principles and legal responsibilities accordingly. Importantly, due to the particularity of privacy invasion by Appstore, the imputation principles and responsibilities taking are more complicated than normal case of right invasion. Besides, it maintains distinctive traits on exemption excuse.The protection of privacy rights is faced with great challenge, but many current relevant acts are a little bit of ambiguous or even unreasonable when dealing with the issue of mobile AppStore users’privacy right protection Therefore, a systematic research on the privacy right invasion within Mobile AppStore servicing can address the issue effectively. This paper consists of following five sections:chapter one:This section firstly illustrates the basic understanding of privacy right, and then delivers detailed description on the nature, characteristics and forms of privacy right invasion within Mobile Appstore. chapter two:Through adoption and summary of foreign relevant legislating model, this section discusses the imputation principles of the legal responsibilities of privacy right invasion within Mobile AppStore.chapter three:This section offers analysis on the essential elements of privacy right invasion within AppStore from the perspectives of consistency, illegality and accountability. This gives a clear picture of the right invasion elements of the legal responsibility.chapter four:Through discussing on theoretical basis and foreign relevan legislating experience, this section explores the applicability of impunity reason for the privacy right invasion within Mobile AppStore.chapter five:Through exploring about the Tort Liability Act, this section seeks to find the form of reasonability taking by subject to infringement.
