The Analysis About Our Adult Guardianship System

With the deepening of the problem of the challenge of the population aging,the social problem is increasingly outstanding,and there is no laws to follow to the physical-mental handicap.In our country,the exsiting system which to protect the adult is laggard and it can’t already meet demands ofsociety.In this new times,it is immediate to refer the advanced legal theory from developed countries. So,this paper analyze the historical origin of our adult guardianship system and its necessity and feasibility firstly,secondly,this paper also study the achievements between this regulation’s reformation and practice from the two legal systems,in view of this,wo get the enlightenment to refer.Combining the national condition and adapting the international concept about human right, the author proposed we should introduce the adult guardianship by conduct and construct our adult guardianship by conduct combined the current regulation at last.In order to protect the challenge of the population aging and the physical-mental handicap’s basic human rights, this paper study the adult guardianship by conduct utilizing comparison method and based on the realistic problem. The author except it can promote the developing about our adult guardianship by conduct.
