| Ever since the Reform and Opening up, the economy of China has developed rapidly and fundamental changes have been made in terms of the living standard of our people. Some well-developed areas even approaching the level of other developed countries. Thus higher-qualified living and more diversified lifestyle become the eager pursuit of the first well-off class. However, the legal problems between the yacht club and its members, especially the legal liability of the yacht club as different subjects, are still in vague. Based on the analysis of the development of yacht industry at the present stage, this paper aims to study the legal relationship of the yacht clubs and its members. This paper would be divided into four parts:The first part would be the general introduction of yacht club and its members. In this part, the concept, types and requirements of establishment, as well as the operating system and existing environment of the yacht club have been analyzed, and the necessity and importance of the study of the legal responsibility between clubs and members have been revealed by illustrating the rapidness and continuity of the develop of such yacht club and the whole industry through massive materials collected.The second part mainly deals with the legal regulations governing the relationship between yacht club and its members. By organizing the laws, administrative laws and regulations, and local laws and regulations, this part aims to provide a path to study the legal relationship between the club and its members.The third part would be the rights and obligations of the club and its members. As different subject, the rights and obligations of the club would be different. This part analyzes the rights and obligations between the yacht club and its members under different circumstances separately.The last part would be the suggestions to the problems during the process of adjusting the relationship between club and its members as well as the development of the yacht club. |
