Domestic Service Contract Research

Along with our country economy rapid development, domestic service industry also hasbecome a hot industry into people’s daily life, at the same time, resulting in a large number ofdomestic service contract. However, China’s current laws for domestic service contractadjustment is almost a blank, to solve the domestic service contract dispute only in theGeneral Principles of Civil Law, the General principles of Contract Law and so on.As a resultof the domestic service contract is a new type of special innominate contract, There are a lotof defects and deficiencies of the law. This resulted in some improvement measures.In thispaper,through a theoretical study and empirical study, try to answer these questions. In thispaper, in addition to the introduction and conclusion, is divided into four parts in structure:The first chapter is the general introduction of the concept of the Domestic ServiceContract.This chapter discusses the domestic service contract ’s concepts, characteristics andlegal nature,which focus on the discussion of domestic service contract’s legal nature.The second chapter is about the establishment and validity of the contract.In thispart,detailed discussion of the rights and obligations of the parties,to discuss the contractresponsibility to do the groundwork.The third chapter discusses our country legal problems for the Domestic servicecontract.Combined with case studies and theoretical analysis,On the legal regulation of thedeficiencies were analyzed and summarized,for the next chapter perfect measures to prepare.The final chapter discusses how to perfect the domestic service contract.Firstly wediscusses the concept, necessity and feasibility of the domestic service contract.Secondly, wediscussed how to set up a standardized contract and application of Civil Law and Labor Lawto comprehensive adjustment.Last but not least,other relevant perfect measures,this chapteralso makes a brief discussion.
