Malfeasance crime is a behavior that the staff of state organs in the process of implementing the official activities, abusing the state conferred powers, failing to perform or not to fulfill legal obligations seriously, impairing national management activities, making public property or the interests of the country and the people suffered a major loss. Compared with other types of crime, the criminal subject is professional and intelligent, the misconduct is hidden and deceptive, and the behavior is consistency, interests is correlation, diffusion of responsibility and the complexity of the background, the case of multilateral and repeated. In recent years, the amount of cases of malfeasance crime is in a serious case upward trend, involved in more and more fields. All these bring a lot of serious damage to the interests of the country and the people. The causes of malfeasance crime are complex, multi-faceted; the political reasons are lack of effective mechanism to power counterbalance and the feudal remnants of bureaucratic; The economic reasons are the negative impact of the market economy and the contradictions and conflicts of the old and new mechanisms of the transition period; The legal reasons are the absence of legislation and the light punishment. Crime Prevention is far better than in the punishment of crime, prevention of malfeasance crime, we should put the emphasis on strengthening the supervision and control of power, improving the existing criminal legislation, establishing and improving the supporting system, increasing the punishment of efforts. In short, the establishment and improvement of malfeasance crime’s prevention system is the problems to be solved in the current situation.
