| This thesis has initiated through a case to the force of the effective civil judgment’s pro-decidedissue. The theory of it has been a sensitive area of the doctrine of civil procedure. The Supreme Court ofthe People’s Republic of China announced their opinion about this matter in a judicial explanation. Butthere are many limitations about the explanation，the judges and the lawyers meet more and moreproblems when handling with the explanation in the complicate hearing practices, then the writer tries tosupplement and improve this rule. |
