Study On Investigation Countermeasures Of The Crime Of Malfeasance

Misprision,abuse of authority and irregularities for favoritism----As a criminalactivity which severely harms society and exerts great negative influence on thesociety, malfeasance crime makes people gradually realize that mediocre officers arenot far away from our lives. A great number of tax evasion, text dodging andcompanies not conforming to laws are under mediocre officers’ instigation.Themassive damage of farmland and plants as well as loss of state-owned land assets arecaused by mediocre officers who illegally approve land use and occupation andillegally transfer right to state-owned land at a low price. Resorting to violence toobtain testimony, maltreatment on person under surveillance are closely related tomediocre officers’ behaviors.At present, malfeasance crime presents a series of characters: profit-seekingtendency of subject ideology, expansion of the field, behavior latent, diversity ofmeans, population permeabilization. All above made investigation of malfeasancecrime face numerous new challenges and situation: the absence of social cognition,obstacles in system, and weakness in working mechanism etc. In view of above, thispaper makes preliminary discussion on malfeasance crime and its investigationstrategy.There are four components in this paper.In the first section, first of all, the author presents the definition of malfeasancecrime from different perspectives, and puts forward his own understanding tomalfeasance crime. Then the author explains the standard of category, features ofcrime constitution and features of cases one by one, and gives a bird eye view ofmalfeasance crime.The second section, mainly discusses about investigation features aboutmalfeasance crime and analysis of difficult problems. On the basis of analysis ofcauses of malfeasance crime, this section makes a comprehensive summary ofcharacteristics of investigation of cases of malfeasance crime. According to this, theauthor analyzes difficult problems in investigation of malfeasance crime oninstitutional level.The third section is the key and core of this chapter. According to procedurerequirements of investigation in the stage of criminal procedure, the author gives adetailed explanation of the four aspects of malfeasance crime one by one, namely,placing a criminal case, investigation and decision, investigative Strategy,investigation and evidence obtaining.
