Realty is closely related to people’s daily life,and then,realty registration system is to ensuer the security of realty transactions in the law system,so the study of realty registration system has a great practical significance.Although the Real Righe Law has established the basic principle and direction for realty registration system of our country,but the majority of the provisions are too abstract,cannot regulate realty transactions well.Therefore should legislate a unified realty registration law as soon as possible.Compared with China,realty registration system of Japan has been developed for100years, through continuous modification, it has formed ralatively perfect realty registration system. This article mainly introduces and discusses the development and perfect process of the realty registration of Japan, and then proposed sugestions about how to perfect our realty registration system.This arcticle is divided into four parts:the first part is history of the Japanese realty registration system,is composed of three sections, the first section is the realty publicty system before the Meiji Restoration; the second section is the realty publicity system determinde by the Meiji Restoration period; the third section is the realty registration law and its development,by the introduction of the three sections, we can understand that the development and improvement process of the Japanese the realty registration system. The second part is the current realty registration system,mainly introduced thesystem and characteristics of the realty registration of Japan,registration authority and register, registration classification and registration procedures. The third part is the effectiveness of realty registration, focus on the analysis of the unique perfidious malicious elimination theory and relative to confirm registration credibility. The fourth part is enlightenment of the Jpanese realty registration system to our country, the first analysed the present situation and problems of Chinese realty registration system, and then put forward five measures to improve from Japanese experience. |
