Approach Exploration Of China’s Police Rights And Interests Protection In The Process Of The Rule Of Law

Police, the defender and executor of a country’s law, has been with us since ancient times. They exercise the right of management on behalf of the country. It is commonly believed among the general public that the police has absolute authority and is in powerful position. In fact, however, although the process of China’s rule of law has been constantly advanced, the living of police, the executor of law, is not optimistic. The cases of violent police-assaulting and the hinder of police’s official duty occurred in recent years indicate that the police rights and interests have often been violated and their authority has constantly been challenged. Premier Zhou Enlai once said that "public security department carries half the responsibility of national security". If the interests of police, the executor of governing the country according to law, cannot be guaranteed, it would certainly effect the execution of law and hinder the process of China’s legalization. Therefore, we must attach great importance to the protection of the rights and interests of the police.On the basis of the existing prior studies, this thesis synthetically used materialist dialectics, chart analysis, illustration and other research methods, put forward the premise of the protection of police rights and interests under the condition of the rule of law, point out that the absence of police power implementation is an important factor of the violation of the rights and interests of police, and suggested the approaches of the protection of police rights and interests from the aspects of awareness cultivation, the achievement of police power, the construction of legal system and the creation of a good law enforcement atmosphere, etc.This thesis is divided into three parts. The first part is about the elaboration of the related concepts of police rights and interests, the relation between the achievement of police power and the protection of police rights and interests and its significance; the second part is the analysis of the ways, characteristics and reasons of police rights violation and the status quo and questions of the protection of police rights and interests; in the third part, the author used the reference of foreign police rights and interests protection, combined with our working experience and put forward his opinions and suggestions of the approaches of police rights and interests protection in the process of the rule of law.
