Identity Information Crime Research

Identity Crime refers to a large dimension of crime,in theinternational society,a lot of countries has already put the identitycrime into legal protection.But in our country,the identity crime isa brand new legal conception,however,it has been noticed by therelevant departments.Identity Crime including Identity Theft and Identity Fraud,it refersto steal,gather,provide and leak personal identity information ofothers,forge false identity information and use these information tobenefit themselves or let themselves free from obligations.nowadays,theinternational society has been doing research on identitycrime,especially in the USA and Canada,those two countries are leadingthe legislation of Identity Crime,we can learn from their experiences.The criminal law of China has put some regulations on the IdentityCrime,the one is <the regulations of Amendment V to Criminal Law of thePeople’s Republic of China>,adding the use of false identity informationto the credit card crime,also the regulations of conviction and criminalpunishment for the act of steal,purchase or illegally provides others’credit card information;the other on is adding a new statute and twoto<the regulations of Amendment VII to Criminal Law of the People’sRepublic of China>.this the very first time of the criminal law to classifythe illegal action targeting the personal information.Also there are someissues in the society relates to the identity crime that needs to solvein time,I.E. the conflict of manpower research and protection of identityinformation;how to distinguish the protection of identity informationbetween the public man and the mass etc.
