National Compensative Scope is the key element in national Compensation system, and it is an important characteristic of a nation’s Human rights safeguard and Legislative work. Our country’s National Compensative Scope is really confined. Although the amendment of the state compensation law which passed on April29th2010has been deliberated4times during5years, it is not entirely satisfactory on the scope point.This thesis will begins from the basic concept, characteristics, and determinate principles of National Compensative Scope, as well as the standpoint of the new rules in The Amendment to state compensation law, then analyze the shortcomings of our National Compensative Scope and compare the relative regulations of other countries and regions, in order to propose the expanded suggestions which is suit for the condition of our country and the developing trend of the world.There are mainly exact the following shortcomings in our National Compensative Scope: the enumerates-like legislative pattern is unscientific, the flaw of Legislative compensation, the Judicial compensation scope is excessively narrow, administrative compensation scope is still not comprehensive and the scope of national compensative object is confined.Aimed at these shortcomings, this paper designs the corresponding measures:establish limited Legislative compensation system(mainly focus on abstract administrative acts); broaden the Administrative compensation scope(include bringing administrative negative act, interior administrative acts, the destroy of publicly-owned public utility, and military compensation into the scope of national compensation definitely), widen Judicial compensation scope(include bringing The Judicial organ is negligent in exercising the authority to cause the harm to human into the scope of national compensation, and cancelling the limiting condition of national compensation to "detain mistakenly"), expand the repairable scope of destroy(spread the protection extent of citizen legitimate rights and interests, bring the available interests into the scope of national compensation) and so on, in order to contribute strength to the researches on the scope of national compensation.
