The competition restriction is based on the loyalty of employees obligations andproduce, the law provides the first competition restrictions purpose is to protect theenterprise with the business secret. Modern enterprise in human resourcesoptimization allocation enjoy brought about by the great economic interests, but alsothe inevitable to take on the employees based on the change of the cause of the tradesecret protection. And employees sign competition restriction agreement, will becomeenterprise to protect its commercial secrets of the one way. But agreed restrictions onboth conservation behavior the rationality of the enterprise business secret rights,there are limits on the free laborer of choosing and limit the irrationality ofcompetition, at the same time, there are also the infringement of citizens’ labor rightsand interests of the possible, thus can be caused to the interests of the workersviolation. Because of restrictions on influence enterprise laborer right to employmentof fully realized, so to labourers shall be given appropriate economic compensation.The basic content of the paper is divided into four parts, the first part of theeconomic compensation restrictions on the basis of analysis theory, including theeconomic compensation restrictions on the definition, properties, characteristics ofdefine, restrictions on the basis of economic compensation produced, and establishingthe restrictions on the rational analysis of the economic compensation system.The second part of the main analysis other countries about restrictions on thecompensation system of economic law and by other countries to the competitionrestriction provisions of the law of the development process of analysis, for referenceto perfect our country’s existing competition restriction system and the developmentof the future direction.The third part it is pointed out that China’s restrictions on economiccompensation system, the problems in the current about the competition restrictionprovisions of the law of the deficiencies, the local law and practice, the differences ofexisting in the case of a conflict between the provisions of the law are described indetail. The fourth part of the main issues in the third chapter, on the basis of analysis,combined with the practice of law rationality, according to the existing legal system ofrestrictions on existing problems in perfect recommendations, and scientific view ofthe debate is briefly introduced, finally to our country restrictions on the developmenttrend of the economic compensation system opinions are put forward.
