Theory Of Plaintiff Qualification In Administrative Litigation In Our Country

Administrative litigation plaintiff qualification is a fundamental problem in China’s administrative litigation system, and also is closely linked to the practice. It is particularly important to study this issue, especially when there are many problems left to deal with in China now. This paper is divided into four chapters to study the China’s administrative system, and will put forward my own suggestions for improvement.The first chapter will study the basic concepts related to the administrative litigation plaintiff qualification to pave the way for subsequent chapters. This chapter will mainly focus on four parts, namely the concept and nature of administrative litigation plaintiff qualification, differences between administrative litigation plaintiff qualification and other similar concepts, function of administrative litigation plaintiff qualification, as well as factors influencing the administrative litigation plaintiff qualification.The second chapter is divided into three sections and mainly to analyze the current qualification system of administrative litigation plaintiff. Section one focuses on three different stages on the history of china’s administrative litigation qualification. Section two is to analyze problems existing mainly according to three aspects, such as range of administrative litigation, standards of plaintiff qualification, as well as the integrity of plaintiff qualification system. Section three analyzes the reasons contributing to these problems.The third chapter is to analyze the plaintiff qualification system of the United States, Britain, France, and Germany and finally put forward some reasonable suggestions based on the analysis of the above-mentioned system.Chapter four is to explore the ways to improve the plaintiff qualification system. Based on the three chapters, the author proposes to improve the system of administrative litigation plaintiff system with views as followings:First, principles that should adhere to;Second, suggestions on specific system construction;Third, establish plaintiff qualification system of public litigations;Finally, establish plaintiff qualification system under the guide of administrative litigation’s type.
