On The Study Of Perfection Of Recall System In China

As comrade Hu Jintao mentioned in the report of the17th central committee of the communist party of China:" we must focus on the management of human, financial and material resources of leading cadres,specially chief leaders, and keep supervision on key poses, perfecting the system of inquiry, accountability, economy responsibility auditing, taking the blame on oneself and resign, recall." It’s not difficult to see that democratic system can not live without recall system, and our recall system is imperfect right now, the imperfect procedure problem is still prominent," easy to be elected,hard to recalled" is still a serious matter. Leading cadres and people’s representatives, once elected, never worry about removal, a few corrupt elements gain the opportunities to grab profits unscrupulously in their term. Therefore, improving the recall system continuously is the top priority and extremely urgent.This thesis has five chapters.Chapterl is about regulations of recall system in our law, including rules of recall system in constitution and several concrete methods.Chapter2is about theoretically summarizing and researching the conception of recall system, elaborating its basis of Constitutional foundation. Chapter3states different countries’impeachment system, analyses our national recall system, gains inspiration about how to improve our recall system through several developed countries’mature impeachment system and legislation. Chapter4makes all-round objectively introduction and evaluation of our recall entities and procedures at present and analyses the causes of existing problems. Chapter5gives suggestions on perfecting our recall system in two aspects:reforming recall entity system, standardizing procedural system.Inclusion, in order to perfect and improve our recall system, we must further reinforce theory research and practice exploration at the height of constitutionalism, solving problems of recall according to legislation.
