Equality of men and women is a basic principal. The quantity of women and the quantityof men in work place are almost same, but there are many areas where sizeable gaps existbetween women and men, worse still, this huge gap is growing, for example, theadministrative levels of female employees are inferior; the employment pressure of femaleemployees is bigger than that of male employees; and the labor treatment and income levelsof female employees are lower than that of male employees. We can find the essential reasonof this phenomenon based on gender theory. This thesis analyzes questions about protectingwomen’s work right based on gender theory and includes four chapters: brief account ofgender theory; research on equal work right between women and men; research on sexualharassment in the work place; and research on specific protection for women’s work right.Chapter one introduces the profound meaning of the concept “gender” and itssignificance. The “gender” means that the different gender roles between women and men arestructured by social culture and social patterns. It clearly points out that free equality is frailand deceptive because there is a law blank in private sphere, gender theory sticks to puttingfree equality in private sphere and affirming it by law. If we want to realize the equal workright between women and women, we must realize gender equality.Chapter two studies the conception and main performances and main obstruct of theequal work right between women and men. Finally, this thesis analyzes the problems inrealization of the equality of work between women and men and comes up with matchingcountermeasures.Chapter three concentrates on the sexual harassment in the work place. Sexualharassment in the work place seriously blocks the realization of the equality in work betweenwomen and men. In this chapter, we insist that harassment in the work place is sexdiscrimination if we analyze this question with gender theory, and only in this way can weremove the radical obstruct. This chapter discusses the rights violated by sexual harassmentin the work place and conception and normative pattern of sexual harassment in the workplace.Chapter four emphasizes on the specific protection for women’s right in work. There isno controversy on giving specific protection to women in our country, but there are differentstandpoints in specific protective measure. First, the range of specific protection for women’sright in work is determined after analyzing related data. And then, the section studies theproblems coming from specific protection for women’s work right and comes up with somesolutions.
