Research On The System Of Judicial Identification Of Mental Diseases

The current system of judicial identification system in China faces with deepen reform. The forensic psychiatric appraisal judicial identification system is a more prominent type in identification system. And many countries have special provisions. However, in our country, the judicial identification of laws and regulations, especially psychiatric disorders in forensic relevant system still remains imperfect. In this paper, based on the current China’s forensic psychiatric appraisal system of relevant laws and regulations, combined with the judicial practice of the actual situation, we propose the present stage of our country forensic psychiatric appraisal system for the main problems. In order to discuss the forensic psychiatric appraisal start program, the identification cross-examination procedure, we compares the two kinds of legal identification systems. What’s more, we absorb the foreign legislation experience to reconstruct our forensic psychiatric appraisal system frame and train of thought.This paper consists of introduction, four chapters: introduction,briefly introduced the Yao Jiaxin case and the Qiu Xinghua case for forensic psychiatric expertise, and Xu Lindong who is heathy but other people consider him insanity to raise issues.The first chapter briefly explains the forensic psychiatric appraisal system general theory.The second chapter separately describes China’s forensic psychiatric appraisal system startup system and appraisal conclusion Cross-examination System in two aspects and its current situation and malpractice. In.the third chapter, we analysis and compare the two law systems in the initiation system and appraisal conclusion Cross-examination System. The fourth chapter puts forward perfecting the forensic psychiatric appraisal system conception.
