The Research Of China’s Procuratorial Reporting System

The Procuratorial reporting system combining judicial supervision and democratic oversight by the citizens is the key element of the socialist procuratorate system with Chinese characteristics. Such a system plays an important role in safeguarding the citizen’s right of reporting, prevention and prosecution of corruption, promoting the construction of a clean and honest government, strengthen the citizen’s law awareness, improving and perfecting socialist legal system, maintaining social justice, and building a harmonious society.In recent years the practice of a large number of new cases, new issue, new challenges to existing procuratorate reporting system. This thesis analyzed the cause of various problems encountered by the procuratorial reporting system, compared with quotable experiences from supervision and inspection systems overseas, and proposed solutions for further improving China’s procuratorial reporting system。This thesis adopted analytical, comparative,and empirical approaches in studying China’s procuratorial reporting system. The text comprised of four parts, totaling40,000words.The introduction briefly discussed the background of this study, current status of procuratorate research and the significance and contribution of this work.The next part is an overview of the procuratorate system. Basic concepts such as reporting, reporting system, procuratorial reporting, and procuratorial reporting system are defined. The inception and development of Chinese procuratorial reporting system are briefly discussed with an emphasis on its content.The third part of the thesis analyzed the current status of China’s procuratorial reporting system. The author analyzed and summarized the general situation and basic characteristic of municipal level procuratorate work, based on the experience gained from working at the procuratorate at city J. Issues regarding the legislation, exercise of procuratorial authority, protection and rewarding of whistleblowers are discussed. The last part suggests several propositions for perfecting the existing procuratorial reporting system of China. This part is the full text of the chapters focus, in view of the current problems of procuratorial reporting system, after examination of the successful experience of foreign procuratorial reporting systems and study of current issues, this key chapter proposed the basic principles for a better China’s procuratorial reporting system, i.e. citizen participation, for the people, seeking truth from facts, objectiveness and justness, strict confidentiality, respect for the rights of the accused, and attaining the trust of people.
