Research On Construction Strategy Of Our Country’s Judge Culture

Along with the establishment of grand target--constructing our socialist country, peoplepay much attention to the judicial justice. The construction of judge cultural is an importantassurance of realization of judicial justice. Hence, many Chinese scholars began to exploreand research how to construct China’s judge system of cultural theory. In addition, the judicialcircles also pay more and more attention to the culture construction. The Supreme People’sCourt issued “the suggestion on Further Strengthening the culture construction of the people’scourts “in2010, in order to vigorously promote judicial core values, just like justice, honesty,and for people, to guide the construction of spiritual culture in court. As we can see, no matterfrom the view of theory or from the view of practice, development and perfection of ourculture of judges is a pressing matter.This paper is divided into four parts: the first part first analyzes and studies the basicconnotation of concept, including judge, judge culture and judicial justice. The judge is thejudiciary skilled with legal skills, a strong national spirit and a wealth of knowledge, andexecutes the judicial power; judge culture is part of a cultural phenomenon, including themodern judicial idea, knowledge structure, occupation ethics and the judge’ EQ, the system ofjudge selection, hierarchy of judges, judge security, judge tenure, judge responsibility, judgetraining and other elements; Judicial justice refers to that the judicial activities adhere tofairness and justice principle. Then, it discusses the dialectical relations between the judicialjustice and judge culture, namely justice is the judge culture’s connotation, and theconstruction of judge culture is the value foundation to realize judicial justice, and is theimportant guarantee for realizing judicial justice. It will be the groundwork for Judge cultureresearch and the discussion. The second part is the study of judge cultural content andfunction. The main part of the culture of judge contains moral culture, management culture,behavior culture, psychological culture, knowledge culture and system culture. The culture ofjudges has much important function, such as: guidance, communication, cohesion, inheritance,restriction and exclusion function. Its context and function highlights the important role ofculture of judges in the establishment of the country under the rule of law. The third partanalyses the problem of building judge culture, such as: the ambiguous location of role of judge, unconsciousness of judge moral, the definite difference of knowledge level, theshortage of judge culture construction of related systems and the imperfect rules, and the mainfactors influencing the construction, such as: pluralistic culture and values, conflict of role, inorder to look for targeted solutions. The fourth part is the research strategy and method of theconstruction of our judge culture. In view of the problems, this paper puts forward tostrengthen the consciousness of judge role to ensure justice, to improve the system, tostrengthen the construction of judges moral, improve the knowledge structure, change the wayof thinking and promote the cultural socialization as strategy method in order to perfect judgeculture.This paper has taken the following research methods: one is the literature analysis: byaccessing, collecting the related literature and data, to master and the relevant information,and to understand the academic frontier dynamic. On the basis of this paper providesreference data; the second method is the theoretical and practical combination method: thecombination of the basic theory about the judge’s occupation moral education of domestic andforeign scholars. the paper describes, according to the characteristics of contemporary judges,in real life the judge occupation moral education analysis of the problems and put forwardfeasible solutions; three is compared method, according to the characteristics of contemporaryjudges, analysis of the problems, to put forward feasible solutions; the third method iscompared method: by the comparison between China and Western countries, to absorb thebeneficial ingredients of the western culture of judges. In conclusion, the construction ofjudge culture should be combined with the practice of our country, summarized theexperience of the construction of socialist rule of law, inherit and carry forward the Chinesetraditional culture outstanding achievement, at the same time, absorb and draw lessons andbasic reasonable factors from other civilization of rule of law, implement gradually andsystematical.
