The Role Reestablishment Of Judges Under The Contemporary Judicial Environment

At present, our country has been in the process of accelerating the legalconstruction, judicial mediation system, which has typical Chinese characteristics, playsa very important role in the civil litigation system of our country. The judicial mediationsystem, together with the judge’s mediation role, has changed a lot since the foundationof new China.This paper, which based on the analysis of general recognition of the judges,deeply illustrates the change of the role of the judges at home and abroad, and thenanalyzes the multi roles of the judges since the foundation of new China and the judge’smediation role under the judicial mediation system, compares and summarizes thejudge’s mediation role at different stages. After that, this paper analyzes the reason ofthe judicial mediation system under the background of mediation priority and thechange of the judge’s role, explores the positive and negative effects on present judicialsituation of our country and conflicts of the judge’s role under the background ofmediation priority. Finally, in terms of the current negative effects and conflicts, thispapers proposes some measures based on system aspect, which perfecting them justfrom the perspective of the judiciary is not enough, what more important is thereestablishment of mediation concept and system.
