Discussion On Administrative Relief Of The Marine Environment’s Pollution And Damage

Since the last century, preventing the pollution of the marine environment has been becoming the most concern of the international community. To solve this problem, countries all over the world had signed a large number of related international conventions, consulted and formulated a series of domestic legislation.The key reason of the pollution about the marine environment is the human activities, but in the end, human beings become the major victims. Thus, on one hand, we must solve the marine pollution from the source. But the maritime industrial activities involved with the marine pollution are the inevitable choices of the progress of human development. So it is impossible to eradicate the activities completely. One the other hand, how to improve the rights and interests protection of the victims has became a big problem in our county, especially for the jurists. But now, the major dilemma about the relief is that it is hard to solve the problem, because of some difficulties, such as the single and limited way of the relief, the requests for relief are hard to allowed, and so on.In order to solve the problems above, this paper takes advantages of the theory of Environmental Law, Maritime Law and Administrative Law to explain the the interpretation of marine environment pollution tort and administrative relief. What’s more, it analyzes the importance and feasibility of combine the environmental tort with the administrative assistance system in one case and come up with an idea of building a system of environment pollution infringement administrative relief.The author said that in the case of environment pollution infringement, as a legal system, the administrative assistance can protects the fundamental rights of citizens, and the related system also have some advantage, that are Security, Relief and Fair. On one hand, it can relief the people who are trapped in trouble in time, and the same time, it can reflect the purpose of the Harmonious Society. On the other hand, it is not only highlights the idea of thinking for people, worrying about the people, serving the people wholeheartedly, but also spread communicates the idea of protection the marine environment and the earth to both the related department and the whole society.
