Research On The Transnational Energy Pipelines Transportation In The Field Of Law

Since the producing areas of the oil and gas are relatively concentrated, however,they are widespread used. Such serious imbalance makes the transportation of the oil andgas to be very important. As the economic and convenient transport method, thetransnational energy pipelines transportation is used by a vast number of countries, andsuch transnational transportation could promote the international cooperation anddevelopment in the field of energy. The same as all of the other international trade, thetransnational energy pipelines transportation also need the International Law to constraintand protect them. As the only and special multiple treaty,<the Energy Charter Treaty>specify the rights and obligations of the signatory states to the treaty, and also provide thedispute settlement mechanisms. Despite that, in the field of the International Law, there isno law that special for the transnational energy pipelines transportation. With theincreasing of the Chinese transnational energy pipelines transportation, our country’s lawin such field need to improved, we need clear and definite law to protect the interest ofthe Chinese government and investors.In the first part of this paper, the intension and the importance of the “transnationalenergy pipelines transportation” has been expressed, this part also showed the conditionof law, introduced the transnational pipelines’ construction in the European, America andMiddle-East Area and also China. Following, the second part introduced internationallaw and the general principals of international law regarding to the transnational energypipelines transportation. The third section described international law problems about thetransnational energy pipelines transportation, which are the problems regarding thejurisdiction, environmental protection and security. Next section, which is the forthsection, is regarding to the dispute settlement mechanisms of the transnational energypipelines transportation, this section classified the kinds of the dispute and also analyzedthe reasons, and then introduced the foundation of the dispute and the dispute settlementmechanisms. At the last section, referring to the legal construction of the transnationalenergy pipelines transportation in the international societies; this part provided somesuggestions to China.
