Song Dynasty Forgive Drop System Of Legal Analysis

Compared with other imperial dynasties, Song Dynasty had great development and innovation in the amnesty system in its types, frequency and systematization. This thesis, on the basis of previous research, analyzes a variety of aspects of the amnesty system of Song Dynasty.Firstly, the thesis sorts amnesty in Song Dynasty into "da she" and "te she" on the basis of their different coverage. The following chapter analyzes five steps of the procedures of this system, including the initiation, drafting, declaration, delivery, and local enforcement of the edicts of amnesty.Then, the legal force of amnesty is analyzed in terms of time, space, person and subject. Furthermore, the author studies the criminal effect, civil effect, and legal effect upon officials of the amnesty in Song Dynasty.Finally, the epilogue discusses briefly the rationale of the amnesty system throughout China’s imperial history, with a particular reference to the historical background in Song Dynasty.
