Mass incidents, as a kind of manifestations of social contradictions, usually emerge in certain periods when various social forms begin to gather or transfer. The high frequency of mass incidents happening somehow reflects the lack of suitability of the existing social form. In nowadays China, with the fast-developing market economy, the sharply-growing claims of citizens, frictions brought by this lack of suitability are exactly the cause of mass incidents in our country.As a public authority most relevant to citizens’rights, the police system affects every corner in people’s life and public order maintenance, thus it prominently embodies the features of expansion and mandatory. Due to this fact, a well-designed police system is a reliable guarantee for people’s rights while an inappropriate police system is sure to cause conflicts between public authorities and people’s private rights. Originated in the wars period, framed in planned economy period, the police system in China failed to adapt itself to the changes of economic life so that it has infringed people’s rights in some occasions. In mass incidents where conflicts between police authority and people’s rights are getting much serious, the shortages of the system have been seen enough. Considering this, it would be a reasonable way to study the police system in China from the angle of mass incidents. This article comprises three parts:1, part I introduced the basic concepts, features and reforms of mass incidents and police power. This part also demonstrated the legitimacy of the exercise of police power in mass incidents;2, part II observed problems of police power being exercised in mass incidents by looking into actual examples, and analyzed the cause of these problems;3, part III discussed the rational reframing of the police system in China in respects of restriction of powers, supervising and administrating mechanisms, control of procedures and team buildings, based on the principles of exercising the police powers.
