On The System Of The Cancellation Right In The Bankruptcy Law

Bankruptcy revocation rights can help to revoke the improper handling acts ofinsolvency estate for the creditor within the statutory period，protecting the interests of thecreditor.Therefore, there is no doubt that the cancellation right is of great value andpracticality in the Bankruptcy Law. On the basis of the renewed awareness upon the value ofthe cancellation right in bankruptcy cases, I focused on the concepts, nature, values, subjectsand the elements of the cancellation right in bankruptcy cases, in order to find the path thatthe cancellation right goes through, and then study on the protection of the cancellation rightand do some comprehensive analysis on it.Taking the character of the Bankruptcy Law into consideration, the cancellation rightcombines the right of claim and formation, and this thesis values the right under theeclecticism. In the second part, I dissected the concept and characters of the cancellation rightin bankruptcy cases, and then analyzed the value of the Bankruptcy Law. On the study of thesuspect of the cancellation right, the third part of the thesis adopted the view that thecancellation right in bankruptcy cases belongs to the trustee in bankruptcy. In the fourth part, Igot information of legality of the cancellation right in bankruptcy cases overseas and focusedon the process, then， analyzed the constitutive elements of the cancellation right in thefollowing. On the basis of the bankrupt theories discussed above, this thesis indicates thefuture and puts feasible suggestions.
