With the continual development and progress of our society, life and health levels hasbeen improved to a certain extent, people’s average life expectancy continues to increase. Inaccordance with the traditional standards of the United Nations is an area over60years old upto10%of the total population, the new standard is7%of the total population of65-year-old,in the region, as entered the aging society. The sixth census showed that13.26percent ofChina’s60years old and over population to total population, it is clear China has entered theaging society. From the development experience of Western countries, we can see that thecharacteristics of an aging society: the aging of the population increases; reduce the effectivelabor of the community; prominent social contradictions; fiscal spending enormous pressure.These factors are sufficient to affect a country’s stable development. China has just enteredthe aging society is still in a transition period of the community, the country’s economicstrength is relatively weak, the undertakings in its infancy, the system is relatively laggingbehind, especially the legitimate rights and interests of the elderly can not be effectively tolegal protection. Developed countries experience has shown that social development to thetransition stage, a series of problems emerged, if not a very good deal with these issues, it islikely the development of society have a negative impact, and even lead to socialretrogression. Our country if not the legitimate rights and interests of the elderly, effectivelyprotect the most likely to trigger a series of social events, serious adverse impact on theconstruction of China’s socialist cause. Strengthening the security legislation on the rights ofthe elderly in China is the focus of social work.This article focused on the rights of the elderly to protect legal issues. The first part is theintroduction, a detailed introduction to the article writing background, purpose, significance,and research ideas and research methods; the second part of the rights of the elderly to protectits legal system, described in detail, by definition of the concept and content and mode ofpresentation, detailed description of the rights of the elderly to protect the legal system; thethird part of the Protection of the Rights and Interests of the Elderly in the legal system; thefourth part of the protection of the legal system of foreign pension on developed countriesThe rights of the elderly to protect the advantages and disadvantages of the legal system. Thefifth part is on strengthening the protection of rights of the elderly in China thinking, and security by way of legislation on the rights of the elderly in China, pattern suggestions.I hope the writing of this article, be able to make some contribution to the securitylegislation for the rights of the elderly in China.
