Since the1990s, the development of the Internet in the world israpidly. According to data announced by the InternationalTelecommunication Union (ITU) on October19,2010,2010, newInternet users will reach226million and the total number of globalusers doubled than five years ago which is more than20billion, ofwhich the number of home Internet access from last year’s1.4billionto1.6billion this year. The29th China Internet NetworkDevelopment Statistics Report was released by China InternetNetwork Information Center (CNNIC) shows that by the end of Dec.2011,the total number of Internet users in China is513million,including55.8million new Internet users. The Internet penetrationrate is reaching38.3%,which is improved by four percentage pointsover the previous year. Chinese mobile phone users reached356million, accounting for69.3%the proportion of total Internet users,increase of5285million over the previous year. Chinese domainnames are a total of7.75million, of which the total number of CNdomain name, to3.53million. And the total number of Chinesewebsite is2.3million. The total number of CN domain name is3.53million, compared with June2011up0.7percent. With thedevelopment of the Internet, the network is bringing human beingsinto an new information age that the information net is an preciousresources. as a new cognitive tools, communication tools andproductivity, the development of network has great influence ontoday’s world,such as political, economic, the enormous impact ofthe military, and cultural aspects as well as people’s daily lives and inthe public domain. But just as people often say that the network is a double-edged sword, it is not only convenient and fast people’s lives,it also brings a series of questions. Government network governancecame into being in this environment. Montesquieu said in "Spirit ofthe Law” that people who has power abuse of power, which is animmutable experience immutable. In accordance with the concept ofmodern administrative law, the exercise of administrative powersshould be subject to legal norms, in order to standardize the exerciseof power and fully protect the private rights. This paper is dividedinto four parts. The Introduction section includes the background、purpose、 research methods and research review. in the first part theauthor try to define the concept of governance and networkgovernance, showing the legitimacy of the Government’s network ofgovernance, the necessity of government networks, the need forgovernance of the Legislation. The second part describes thelegislative situation of Chinese government network governance,including the achievements and existing problems. The third partdescribes the legislative situation quo and experience about networkgovernance in EU countries、United States and Japan. The authortry to build the Chinese network governance system and explain theprinciple form content and procedure of the legislation.
