The Research On The Legal Regulation Of The Bribery In The Village Committee Elections

In this paper, I tried to study bribery in the village committee elections in China. The paper is divided into three parts. In the first part, vote-buying and current status of village committee elections was described, and there was also included overview to the issue of China’s village elections, and a comprehensive and in-depth study. Bribery in the village committee elections was accompanied by the emergence of China’s village elections and democracy emerged. Chinese grass-roots democratic elections of village self-government system is the real source of the city’s neighborhood electoral system, which was set up after the village’s. And bribery is the phenomenon of the early development of democratic elections. Our village committee elections was built less than a decade of years, so the emergence of bribery was not surprising. In other countries, vote-buying was also very common in the early age of democratic elections. However, gradual improvement in the democratic electrical system, the vote-buying phenomenon has been a fundamental control. China faces the same problem that institutional and legal issues, so bribery is more serious. Openness and universality of such behavior indicates a lack of legal regulation of the village committee elections. From a deeper study of the bribery in the village, it is the power of the personal. The village committee has a certain degree of public authority. If someone get the power by bribery, he would not like to serve for the villagers. The briber will reap private interests through the use of his authority. It is the destruction of village democratic electoral system, the spread of the phenomenon of bribery broken impartiality of the elections. The villagers will lose their confidence in the elections. The second part is about the definition of the concept of the village committee vote-buying, bribery first define the concept, introduced foreigh laws and academic point. And they all have their advantages and disadvantages. So we must study them seriously. Bribery in village elections is very common, but most of them is not found, which is because there is not clear definition of what is bribery. So those who seize the legal loopholes, is engage in the acts of bribery. Concerned about the grass-roots democratic electoral system, more and more scholars start to study the problem. Scholars of bribery put forward their own point of problem. Scholars of bribery put forward their own points of view, identify their strengths and shortcomings, provide the basis for our definition of bribery. Overall, foreign law definition of bribery is a list of the main ways of bribery, which is simple and clear, and os easy to identify in practice. The third part is the issue of governance of the village bribery. In this section, the problem for our village community election vote-buying, in the front to prevent, control the matter, after the punishment of a different point of view, made a perfect village election procedures, the establishment of the village committee election monitory system, to develop Village Committee Election Law, good use of existing legal system and other measures to establish a comprehensive system. If we want to eliminate bribery completely, we must improve the electoral process. We must try our best to make the village committee election procedures become fair and open, so the bribery will be less and less. In this case, every move of the bribery of those is exposed in the sight of all the voters, and they have to consider the consequences of their behavior. There is election monitoring system in some Western countries. Our country is also necessary to set up a committee monitoring system. Though the above research, we can concluded that the phenomenon of bribery in the village committee elections is capable of administering. With the continuous improvement of the electoral system of grassroots democracy in china, the phenomenon of vote-buying will be less and less, the village committee elections will be more fair.
