The Research Of International Cooperation Legal Mechanism Fighting Against Somali Pirates

As the long-standing social phenomenon piracy, the international society hasbeen preventing and suppressing the piracy unremittingly for a long time, particularlymaking great effort in the setting of punishing piracy laws. In recent years, therampant behavior of Somali pirates makes people pay close attention to the problemagain. The Security Council has adopted a series of resolutions to calls on all thecountries of the world making effort to combat piracy with cooperation.Somali pirates are so rampant because of its specific origins. It is the trueportrayal of the current domestic situation in Somali, and it also reflects the crisis inthe humanitarian, political, economic and other aspects of this country. The operationsagainst pirates are inseparable from the international society’s cooperation. Especiallywith the expanding of Somali piracy region and the showing of the new features, theinternational cooperation becomes more and more necessary. By analyzing the statusof international cooperation in the fight against Somali pirates, we found we werefacing some dilemmas.This paper mainly discuss on the international cooperative legal mechanism offighting against Somali pirates, focusing on the analysis of the current situation of theinternational cooperative mechanism, pointing out the existing problems, and then usethe international cooperation and international mechanism theory, combining with thecurrent need of fighting pirates with international cooperation to discuss on how toperfect the international cooperative legal mechanism of fighting against Somalipirates.The first part is "The origin of the fighting against Somali pirates". At the basisof the comprehensive analysis of the Somali rising process and the reason of therampant pirates, this paper pointed out that the new development trend that the Somalipirates presents made the international community face with different levels of threatand challenge, and the threat posed to the international community even went beyondour imagination, so international cooperation was badly needed to cope with thisproblem.The second part is "The importance of the international cooperative mechanismof the fighting against Somali Pirates". It briefly introduced the theory of the international cooperation and international mechanism. Then it analyzed themechanisms of international cooperation in the fighting against Somali pirates.The third part is "The analysis of the present situation fighting against Somalipirates with the international cooperation mechanism." First, it analyzed thelegislative status and the existing initiatives of the international cooperation in thefighting against Somali Pirates. Then it pointed out the problem in the current fightingpiracy with the international cooperation mechanism.The fourth part is "The thinking of perfect the legal mechanism in fightingagainst Somali pirates with the international cooperation". On the current internationalcooperation mechanism problems, combining with the current need of fighting pirateswith the international cooperation, we should explore the new thinking actively,which can deal with the development of the Somali pirates with the internationalcooperation.
