The writer made a systematic study about the construction of thelegal system of China’s rural social pension insurance by using ofhistorical research methods, comparative research methods and literatureresearch methods, and put forward some new insights and policies tosolve the problems of rural social pension insurance system combinedwith China’s national conditions in rural areas. The section discussed by thetheoretical foundation, the legislative basis and the practical basis.The part IV is the international inspection and enlightenment to construct and improve the legal system of rural social pension insurance.This part is discussed by the mode of rural social pension insurance legalsystem abroad, the way of legislation, the government management styleof old-age insurance funds and the financial burden approach, and putforward some enlightenment to our country by analysis of the advantagesand disadvantages of the various ways abroad.The part V is the current situation of China’s rural social pensioninsurance and legal issues. The writer listed the status quo of China’s ruralsocial endowment insurance of Zhejiang, Henan and Gansu as anexample in accordance with the level of economic development. Atpresent, there are some legal issues about rural social pensioninsurance.For example,the lag in legislation and the legislative level islow, legislative fragmentation, lack of convergence and mandatory, lowcoverage, low level of protection, and the socials relief nature is notevident.The sixth part is the the basic concept of the legal system of China’srural social pension insurance to establish and improve. That part isdiscussed to the issues raised in the fifth part of the paper, and the mostimportant is the design of rural social pension insurance law and therelated auxiliary legal system to build and improve.
