In recent years, the "housing" has increasingly become the focus of attention. In2003,houses’ prices began to soar. In2010, the government introducted the regulation of pricesmeasures. In the National People’s Congress and the Chinese people’s PoliticalConsultative Conference two sessions of2012,"Home Ownership" is still a deliberatelyimportant livelihood project.The housing problem has been affecting people’s livelihood. Inorder to optimize the allocation of social labor force, China has set off a boom to work forothers.For Some vulnerable groups, the best way to solve the housing problem is to renthouses. In the lease field, no matter it is commercial lease or residential lease may befaced with many problems. Our history background of housing lease legal system is complexand be resricted by real factors.So it should be a hot academic topic.Currently, the Amerlcanlease system is more mature and its history has several similarities with China’s. From thecomparison of the Sino-US lease legal system, it is rather meaningful to find a shortcut forChina’s national conditions.Using the method of comparison,this article contains four parts to analysis the headvantages and disadvantages of the system of housing lease between China and the USA.The first part is the introduction,mainly introduces the background and the methods of thisresearch, which shows Chinese and foreign scholarship on this topic. The second part is thehistorical overview of the system of housing lease between China and the USA, in this part,it builts the theoretical foundation for this article, by the method of comparison. The thirdpart is the comparison of the current housing lease’s legal system between china and theUSA, in order to find out the inadequate of the system of housing lease in China; It is partcompares the housing rental contract between china and the USA, which analyzes thedifference between the two countries from the legal point of view. The fourth part is thethoughts of the future viable housing rental system in China, including the legal definition ofthe rental right,the legal protection of the rights and obligations of the lessee and the lessor.By comparison, we also should be aware that economic system and social system in theUSA is very different from China. Learning from the advanced experience of the UnitedStates at the same time, we should be based on Chinese economic situation, and developthe practical planning of the legal system of house lease,to improve the legal system of housing lease in our country.Writer hope to use this article to arouse the concern of the legal system of housing leasefrom the academic colleagues on the legal film.We can find and solve problems by practicing, in order to make the house lease legalsystem more and more scientific.
