Gay Families Related Legal System

The historical principle implied by mankind that "marriage is a combination of man and woman" is evolved to today. However, with development of homosexual rights and human rights campaigns, people have become more tolerant to the homosexual than before. As two important sectors of legal systems related to homosexual families, legislation of homosexual marriage and adoption by homosexual couples have been given most attention by worldwide countries in terms of stipulating their homosexual laws. Homosexual marriage and adoption by homosexual couples are establishment and implement of the family of homosexual couples. While it’s difficult to accept the homosexual marriage in the world, out of protection of human rights, it’s necessary to make research on homosexual marriage on the basis of related family laws by applying other laws related to family to resolve the problems arising from homosexual families.The first part of paper intends to analyze the history of homosexual combination which would shape new mode of family. With the confirmation of non-pathological changes for the homosexual and decline of traditional family’s function, it makes a reasonable foundation for emerging of new mode of families. The second part and third part are to discuss the current legislation of countries in the whole world, summarize the legislating modes and legislating advantages and shortness among various modes according to current legislations of countries. The fourth part aims to discuss the adoption situations of continents respectively based on location division with regard to continent, and analyze standings on the homosexual adoption systems legally. The last part is to bring up with legal thinking and enlightenment on the establishment of homosexual systems in China based on studies on homosexual family systems related to foreign countries.
