Research On The Legislation Perfection Of Urban Management Administrative Law Enforcement Process Under A Service-oriented Government

Urban management administrative law enforcement has become a hot issue in China. There are constantly emerging events of violence of law enforcement and violent resistance to law enforcement in the area of administrative law enforcement. The primary cause is that China’s urban management administrative law enforcement procedure in legislation is not perfect. Along with the service-oriented government concept, Chinese citizens have raised new requirements for urban management administrative law enforcement. What’s more, the old administrative law enforcement mode can not adapt to the requirements of service-oriented government. Therefore, it is necessary to perfect the procedure of the legislation in urban management administrative law enforcement.This thesis focuses on the problems existing in China’s urban management administrative law enforcement procedure in legislation and raises countermeasures for its perfection. The process of putting forward the service-oriented government is briefly introduced, and this kind of government’s influence on the administrative law enforcement is also presented in this thesis. Through analyzing the present situation of urban management administrative law enforcement legislation procedure, it is found that there are deficiencies in this legislation procedure. Then this thesis will give a deeper understanding of the defects in this legislation. Based on one of the main existing law guidances of urban administrative law enforcement procedure Administrative Punishment Law, this thesis raised suggestions to perfect urban management administrative law enforcement legislation procedure in China.There are more than30,000words in this thesis, and it can be devided into five parts:The first part is the introduction of research background, related research at home and abroad, and presents the framework and research methods of this paper.The second part consists of the introduction of service-oriented government and its impact on the urban management administrative law enforcement. It mainly discusses the service oriented government’s raising and connotation, which provides background of the following part. Thus, it makes it clear that what role urban management administrative law enforcement organs play in service-oriented government.The third part is the present situation of urban management administrative law enforcement legislation procedure and the existent problems in it in China. It points out the imperfections, including defective informing procedure, lacking of consultation and performance system, unclear provisions for explaining the reason, and the imperfective administrative hearing system.The fourth part is to analyze the causes of existent problems in urban management administrative law enforcement procedure, giving a more deeper interpretation on it grounding on the third part.The fifth part is about the legislation procedure perfection of urban management administrative law enforcement. And it puts forward some suggestions of the perfection in legislation. This part is also the base and core part of the whole thesis.
