Legal Analysis Of Blue Trade Barrier In International Trade

As the changing of the international trade environment, the traditional trade barrierscannot play the role of protecting the international trade as usual. At the same time,the blue trade barrier as a new type of trade barrier is favorited by the developedcountries, because it has special characteristics which is more easier to use andeconomic to protect their trade from the developing countries. As a major exporter oflabor-intensive industries country, China has to face the blue barrier urgently. Thispaper discusses the legislation about the blue barrier of the countries in the world,and the relationship between the multilateral trading system and the internationallabor standards. This paper adopted document analysis method, empirical analysismethod, comparative analysis method and information analysis method and so on.This paper intends to find out a way to protect the labor’s rights under themultilateral trading system and how to face the blue barrier. On the base of theresearch,this paper made a conclusion that the International TradeOrganization(WTO) cooperate with the International Labor Organization(ILO) willbe a effective way to protect labor rights, the mean time it will help the developingcountries coping with the blue barrier. After analyzing the status of China insuffering from the blue barrier, made the suggestion from the legislation andenterprise’s aspects.
