With the development of economy, the environmental problem becomes more andmore serious. In1997Criminal Law of the PRC set a special section to stipulate thecrime of undermining environmental and resources protection, which is enough to showChinese attention to the environmental protection. But from present’s view, Chineseenvironmental and criminal legislation has obvious deficiency and it must be urgentlyimproved, because Chinese environmental and criminal legislation starts late and thephenomena of environmental crime emerge frequently. This paper falls into fourchapters to investigate environmental crime:Chapter I defines the concept of environment and environmental crime. Throughdefining the concept of environment and environmental crime, the author makes clearthe characteristics and constitutive requirements of environmental crime and putsforward that the object of environmental crime is the environment right.Chapter II introduces environmental and criminal legislation overseas. The authoranalyzes the characteristics of the environmental and criminal legislation in variouscountries and the development trend of international environmental crime, which laysthe groundwork for China to use foreign environmental and criminal legislation as asource of reference.Chapter III analyzes environmental and criminal legislation in China. Throughfinding out the present situation of the environmental and criminal legislation in China,the author hopes to find the problems and effectively resolve them.Chapter IV elaborates the improvement of environmental and criminal legislationin China. In this chapter the author analyzes from the legislation system, the system ofpunishment and constitutive requirements, and puts forward her own ideas.
