Local Government Financial Expenditure Restraint Of Rule By Law

As an important part of national finance, financial expenditure means fiscal funds paid by the government to provide public products and service and meet the common needs of social community in market economy. Financial expenditure fund comes from various national incomes. It is redistribution of funds collected and often related to the public interest. As an administrative power, financial expenditure power is born with infringement and expansion and will harm public interests in turn if not constrained duly. The fundament of rule by law, as a governing philosophy, is right limit, making power performed and implemented under the eyes of the public. The study of local government financial expenditure restraint of rule by law is of great significance. At present, there are many problems in China’s local government financial expenditure field, such as financial expenditure offside and absence coexistence, financial risk increase due to expenditure scale expansion, low financial expenditure efficiency and severe corruption. All these problems are caused by current system in some extent, but also have something to do with the law. More specifically speaking, poor rule by law restraint, which can be mainly reflected as imperfect financial expenditure law system, absence of financial expenditure supervision, lack of legal procedure restriction for the financial expenditure operation and lack of accountability relief mechanism for financial expenditure illegal act. Although holding different ideology, the United States, Germany, Australia supply us useful experience in completing our financial expenditure restraint system of rule by law. Combined with the experience of other development countries and the requirements of rule by law restraint, following measures can be taken to achieve local government financial expenditure reasonable restraint of rule by law:improving the local government financial expenditure legal system, establishing local government financial expenditure supervision mechanism covering the entire expenditure process, implementing the law strictly according to legal procedure and improving the local government financial expenditure illegal act accountability relief mechanism.
