Urban planning should receive the protection of intellectual property rights,as ithas agglomerated human wisdom and created knowledge achievements.The researchon Intellectual Property Protection of urban planning in China has lagged behindother countries because of start late of urban planning itself. So it is a urgent task todevelop the establishment of Intellectual Property system in urban planning, whichneed to learn from foreign experience as public participation and consideration ofChinese national situation.With the purpose of analysis on the deficiency in Intellectual Property law abouturban planning and discussion about some measures that can develop the IntellectualProperty Protection of urban planning, This thesis mainly discourse the following sixaspects: the introduction of urban planning, the theoretical analysis on legal andregulatory systems of Chinese urban planning, the Intellectual Property Protection ofurban planning, and the development of Intellectual Property law about urbanplanning, which some methods are applied to, for example, the inductive research,comparative analysis, theoretical analysis and the analysis of economic constitution.The first chapter is an introduction discussed the Intellectual Property of urbanplanning which related to the development of nation and society should be protectedand supervised under special laws, consideration of its importance.The second chapter is legal principle analysis on Intellectual Property Protectionof urban planning; it is pointed out that why urban planning should be protected bylaw of Intellectual Property. And the reason for the protection of Intellectual Propertyin urban planning, as well as some different ideas about that, is indicated at the sametime.The third chapter is theoretical discussion about legal and regulatory systems ofurban planning. The origin of Intellectual Property Protection in urban planning isanalyzed on the premise of that the legal and regulatory of it has been elaborated.Priority work on this part is to find out the theoretical foundation of IntellectualProperty Protection in urban planning by analysis on domestic and foreign legalsystems about it.The fourth chapter is about the current situation analysis of Intellectual PropertyProtection in urban planning. The characteristic and range of this are analyzed; the subject and object of Intellectual Property Protection laws are also presented. Thelacking or deficient in this protection lead to unfavorable conditions in urban planningas a result.The fifth chapter illustrates how to develop the Intellectual Property Protectionof urban planning. First is to build up the protection system in the matter of patentright, trade mark right, commercial secret right, copyright law and administration.Second is how to ensure the protection in the matter of material supply, incentivesystem, financial policy and government procurement. The last is to carry out theprotection in the matter of personnel training, application and education.In the last chapter, some proposals and measure are presented for improvingmaneuverability of the Intellectual Property Protection in urban planning, optimizingfeedback mechanism of the protection, and ensuring the education and training. It isnecessary to reinforce the propaganda work on Intellectual Property Protection inurban planning and strengthen people’s consciousness about the Intellectual PropertyProtection laws.
