Food safety matters the fundamental interests of people’s lives and health. It is particularly important to ensure food safety and establish a scientific and reasonable legal accountability mechanism."Food Safety Law" has made a lot of progress in the liability provisions than in the past, but there are still flaws. With technological progress and development, risk of food security is also increasing and food safety threat to human health will increase. Being in a risky society, food safety is characterized by the uncertainty of threat object and the uncertainty of damage. Relying solely on food safety perpetrators to duty the damage and compensate for the victims has been proved apparently powerless and not able to satisfy all his victims. Therefore, the traditional perpetrators-oriented principle must be changed; instead, establish theory of liability assignment adhere to precautionary principle to meet society needs; establish a scientific and rational legal accountability mechanisms based on the idea of the subjects of legal relations, the legal relationship of the main obligations.This paper discussed China’s food-safety law system constitutes from the point of allocation of responsibilities and the legal framework, legal relations and the main obligations of the legal responsibility; the paper points out status and shortcomings of China’s food-safety administration, civil, and criminal liability, and put forward suggestions for improvement from the three responsibilities.
