| The right to housing is not only one of the basic human rights, and is one of therights protected by the social security system which protected by our ConstitutionLaw. However, with the accelerated development of China’s urbanization, more andmore people are hard to protect their right of housing, and Shanghai’s housingdifficult is more prominent. In order to solve the problem, Shanghai began to buildlow-rent housing. But some people obtain low-rent housing by deception orconcealment, and the key reason is the low-rent housing access mechanism is notperfect. Previously, the scholars mostly analysis it from the large angles, such as itsproblems, causes, and then propose a solution. On the basis of previous studies, theauthor want to introduce the governing body, audit system, legal liability system andso on of Shanghai low-rent housing’s and Hong Kong public housing’s accesspermission mechanism, and then targeted propose practical suggestions forimprovement.The body of the article has four parts:Chapter one, first clarify our constitution protect citizen’s right of housing. Thenexplain Shanghai and Hong Kong are comparable and the low-rent housing and the public housing are similar. Later introduce the history of Shanghai low-rent housingand the defects of the access permission mechanism of low-rent housing in Shanghai.Last introduce the history of HK public housing and the successes of the accesspermission mechanism of public housing in HK.Chapter two, it is the comparative and analysis of the regulatory agencies ofShanghai’s low-rent and HK’s public housing. The low-rent housing’s regulatoryagency is the housing security and the housing authority of Shanghai city, and thepublic housing’s regulatory agency is the housing authority and housing department ofHK. By compare both of their history, personnel and organizational structure, andfunding sources, recognized that the housing security and the housing authority ofShanghai city should improve itself like these: clearly understanding its stage now andthe direction in the future, increase its staff, established more professionalorganization and sustainable financial self-sufficiency.Chapter three, it is the analysis of the audit system of the low-rent housing andthe public housing. First introduce the eligibility criteria and the kinds of the rent, thespecific audit steps, the post-inspection of Shanghai and HK. Then compared andlearned that Shanghai can improve from the following: make the government’s everyeffort to build low-rent housing, establish a dedicated audit team in the low-rentagency, improve other related system, increasing the sampling system in thepost-inspection.Chapter four, it is the analysis of the legal liability system of the accesspermission mechanism of low-rent housing and public housing. First introduce thelegal liability and the reporting channels of Shanghai and HK, then compared andknowing that Shanghai can improve like these: make the applicant’s legalresponsibility more stringent, like increasing fine and imprisonment, and the provepeople also should have legal responsibility like the applicant and so on. |
