Brief Analysis On Criminal Injunction

With the amendment eighth to the Criminal Law of the People’s Republicof China officially announced, criminal injunction gradually comes intopeople’s sight.With the death penalty is abolished and the constructionof criminal penalty is adjusted,criminal injunction is also attractedextensive attentions.The contents about criminal injunction neverappeared in the Criminal Law in the past,so it is strange to the public.It definitely draws public’s attention, but on the other hand, there arestill filled with doubts and criticisms. The first half of this thesiselaborates the concepts、characteristics and contents of the criminalinjunction, then proves the justice of criminal injunction and analyzesthe deficiencies of practices at present and proposes some constructivesuggestions on the improvements. It is composed of four chapters of thewhole passage:The first chapter makes an introduction on criminal injunction. Onthe basis of definition, criminal injunction is an innovation on theexecution and supervision of punishment. The basic characteristics canbe also seen in this chapter.The second chapter, as the author taking different controversies over current criminal injunction for example. The focal points are revealedby implicate analysis and comprehensive research while it is proven thatthe necessity and practicality of criminal injunction.The third chapterexpounds the principles、declarations and specificenforcement measures in order to obtain wider and deeper understandingof this rule.The fourth chapter consists of the defects for legislation andjudicial practice and pertinent suggestions on these concrete issues,being the impetus to reconstructing the criminal injunction system.Although the criminal injunction remains have some defects,and manyquestions are expected to be solved in the future.We believe that withthe development of this new rule,criminal injunction will be improved andbring about its value.
