The Study On Urumqi Juvenile Crime Community Correction

Community correction system has been put into experiment in6coastalprovinces of our country since July2003and it has been covered31provinces, citiesand autonomous regions by the end of2011. Community correction has receivedgood result in our country, with re-crime rate of inmates kept at0.2%. Withtheoretical basis of criminal jurisprudence, sociology and economics, communitycorrection is in conformity with modesty principle of criminal law. ImplementationMeasures of Community Correction will formally come into force on1March,2012.The teenagers, as successors of the motherland, should be kept under specialprotection since they are different from adults, both of psychology and physiologyaspects. Community correction system has developed for a long history abroad,compared with that of our country, it is more complete, stipulated more details, morericher on content with many modalities like conditional release, community-basedorder, compensation order, home confinement, electronic monitoring, militarytraining correction center, management center, daily report center, etc., has madedifferent provisions for different ages, for instance, supervision order and action planorder apply to criminals under18years old. The No.33Article of ImplementationMeasures of Community Correction of China made exclusive provisions oncommunity correction of minors, but it is relatively general. At present, minorsreceiving community correction of our country accounts for2.8%of the totalpopulation of community correction inmates. Started relatively late in Urumqi,community correction temporally rests on the elementary stage such as transferringmaterials, establishing supervise files and understanding life dynamics, and it fails toestablish distinguished management methods for minors from the adults. As forteenager community correction in Urumqi, the author presents many suggestions suchas strengthening crisis intervention, completing appraisal, increasing organization and steadying community correction work team, etc.
