Research On People’s Housing Rights And Its Realization In China

House has a close relationship with people. The houses will be useless without people living in, and the people will lose their fundamental personal security if they have no houses to live in vice verse. Nowadays, because of the increasing high house price and the ineffective housing security measures, many people are getting into trouble because of lacking houses. Therefore, housing problems has also become a very high degree of social concern problem. To solve these problems, Chinese government further strengthens the regulation and control of the real estate market, and tightens the executive power of the housing security system to strive to realize the all-round implementation of citizen’s housing rights. Thus, housing rights gradually be noticed by people and be paid much higher attention.Housing rights, also known as the right to housing or the right to adequate housing, refers to that people should have the rights to enjoy living the houses with equipped facilities which are ensured by China and the house can be constantly perfected. It is a complex and comprehensive right, and is a representative valuable outstanding point in human rights. This thesis, in addition to the introduction, will expound on this argument from four parts. In the first part, it argues that how housing rights can be named as a kind of human rights. In this part, that the question why housing rights is human being’s fundamental need is explored. Then it is followed by the analysis of the appearance of housing rights, of its definition and of its main contents concerned. Next is to further inquiry of housing rights. It put forwards that housing rights, as a basic human right, has a kind of constitutional and protective rights. Finally, the main content of this chapter is summarized. The second part is about housing rights’current situation in China and the analysis of its’reasons, which includes two sections. The first section briefly discusses the present situation of housing rights in our country’s citizen and the second section is about some analysis on such current housing rights’situation. In the third chapter, some active recommendations on how to promote the realization of our citizen’s housing rights are put forward. Now our country has gained some useful enlightenment from foreign countries’ three types of political policies on how to protect citizen’s housing rights. Thus on the basis of the exploration and the study of relevant foreign policies, some recommendations are brought up to consummate the safeguard measures of China’s housing rights, which include the following three aspects:clear government’s responsibility and fulfill government’s obligation; improve the construction of the legal system; consummate the housing security system. The last part is a conclusion. Basing on the above analysis, the housing rights’ current situation in China and its relative theories are summarized in this part. Meanwhile, the author presents keen vision for housing rights’development in China.
