This article takes "Dan-Xin archives" which written by Taiwan professor Dai Yanhui as the mainresearch material. Based on the records of real case analysis and interpretation, it tried to restore the realprocess of Taiwan County Yamen in Qing Dynasty and summarized the characteristics of judgment in thelate Qing Dynasty, therefore got some personal views from the ways and evidences of trial showed in thefiles.This paper consists three parts: introduction, text and conclusion, there are four chapters in the text.The introduction describes the background and methods of the research. Through historical andempirical method, researching archival documents, viewing the existing research results, this articlerestored the process of judicial operation in the late Qing Dynasty County, which contains the methods,characteristics and analyze. The text includes four chapters. The first chapter" Dan-Xin archives" showedthe trial functions of the subjects in criminal cases, such as the operation of magistrate, officer, post-mortemexaminer in case of judge, knew their powers for trial direction of decisive action. The second chapteraccording interactive presentation and analysis of one or two homicide cases in the" Dan-Xin archives" toshow Taiwan County trial procedures in the Qing Dynasty, through inference, accurate, judge and trail fouraspects analysis. Third chapter, from the characteristics of county judge in" Dan-Xin archives", there aretwo different points of view the Qing Dynasty magistrate judge: subjective attitude of the county judgeorganization, whether delay in the cycle of judge. Chapter Four is the summary and sublimation of the fulltext, through purpose, ways and evidence of judgment analyzed the character of County trial in QingDynasty, for the stability of society. Even the homicide cases, if no death and other serious consequences,the magistrates always using mediation and persuades means to quell disputes; there is no obvious meaningof judicial characteristics. Magistrates judged the" important cases" with variety of means, the evidencealso diversified. |
