Potential negative effects brought by economic integration has become a hot topic in the international discussion and sparked an international outcry, environmental issues caused by global trade activities is an important issue which all the nations are trying to solve, and also an premise for sustainable development of global economic and human society。 The point that global economic integration or regional economic integration should not be at the expense of environmental interests is accepted by more and more nations and international organizations. With the development of trade and investment liberalization, energy investment has become an important part of the investment field, more over, according to the natural and social properties, environmental investment surely bring worldwide environmental issues, so that people form all social circles pay close attention to the problem。When it comes to China, continue to strengthen international cooperation in the energy field, focus on the legal coordination of energy investment and environmental protection has become practical needs, especially after the China joins the FTA, more improvement should be done in the field of energy investment and environmental protection, to keep sustainable development and make due contributions to worldwide environmental protection.This article are divided into four parts remove introduction and conclusion:The first part mainly summarizes the basic legal relationship of trade, investment, energy and environmental protection, respectively in the perspective of the relationship between human and nature, trade and environment, in the perspective of international environmental law analyzed the relationship between energy investment and environment protection. First of all our relationship with nature in the process of human evolution point of view of the reality of a large number of serious environmental problems and areas of philosophy of Marxist principles to the specific argument, the human relationship with nature, natural, directly reflects the transformation of the natural world in human activities is bound to impact on the human environment, the destruction of the natural environment will restrict economic development, the progress of human society, the relationship between the human development of energy resources, energy investment and environmental protection is the interaction and impact. Again the context of integrated development in today’s economic liberalization, economic and environmental development of relations between trade and environment point of view to explain a new trend, and in order to reveal the importance of attention to environmental protection in the process of global economic integration, investment, energy has become an important aspect of the field of trade and investment relationship between the energy investment and environmental protection in the background of rapid economic development is moving increasingly closely the trend of development. At last, in the trend of international environmental law become hard law, through the relevant conventions of international environmental law, multilateral treaties, bilateral treaties to analyze the relationship between comparative energy investment and environmental protection.In the second part, we interpreted the relationship between trade, energy investment and environment protection in the respect of legal regulation, mainly including the legal regulation under the framework of WTO, and legal regulation of regional economic organization and legal regulation of Energy Charter Treaty, we research the relationship between energy investment and environment protection in the method of analysis the legal attention of environment protection. In the third part, take China’s accession to the FTA, and by the analysis of environment law of FTA, we can draw the conclusion that China paid more and more attention into environment protection especially after the accession to FTA, and China is coordinating the relationship between energy investment and environment protection step by step, to ensure China’s sustainable development。The fourth part is the prospect of the future and China’s learning form international environment law in the field of the relationship between energy investment and environment protection。And brought forward the view of coordinating the relationship between energy investment and environment protection in the respect of domestic and international。In the respect of domestic, mainly including legislation and policy, and in the respect of international, including to strengthen international cooperation, and improve the overseas investment norms, those can coordinate the relationship between energy investment and environment protection。...
